Overview of LERAP project:
LERAP stands for Legal Reform Assistance Project. LERAP is funded by Canadian International Development Agency (CIDA). The overall goal of LERAP is to assist the GoV reforming legal and governance systems by achieving greater efficiency, equity, coherence and transparency in the Vietnamese legal systems.
The purpose of the project is to support the GoV in developing mechanisms capable of assuring coherence in the law in order to promote sound economic development, as well as assuring a society "ruled by law":
- Fulfilling the requirements to bring Vietnamese law into compliance with mandatory WTO obligations and the schedules of commitments for trade in goods and services, which are still to be negotiated, represents a formidable technical challenge involving the review and adaptation of almost all economic legislation.
- Building the capacity in the Ministry of Justice (MoJ) to implement obligations in international economic arrangements and to assess the legislative implications of ongoing international negotiations will contribute substantially to improved governance in Vietnam and enhance prospects for trade, investment and economic growth.
- Strengthening the enforcement of civil judgments and enhancing legal research skills will contribute to consolidating of the rule of law in society.
- By improving economic governance and strengthening rule of law, the three facets of the Project will contribute to the equitable development of Vietnam.
Project structure: The project consists of three components addressing three priorities:
- Process of accession to the WTO and approach to international economic integration (WTO)
- Contribute to improved administration of justice through improved enforcement of civil judgments (CJE)
- Contribute to the achievement of greater coherence and practical relevance of Gov's system of normative documents (Comparative Law - COM)
Under LERAP project, there are three components: WTO, Comparative Law (COM) and Civil Judgment Enforcement (CJE)
WTO component
WTO component activities in accordance with the current working plan will support staff and institutional development in the areas of:
- legislative drafting and review;
- dispute settlement training;
- and access to resources/materials for the research work by the ASEAN/WTO Work Group (WTO WG) and the International Law Department (ILD).
As per the revised WBS for the WTO Component, the planned results include:
- Enhanced capacity of the MoJ in international economic law and, specifically, in supporting the GoV in preparing and implementing a comprehensive agenda pertaining to the meeting of obligations for WTO accession
- Capacity is built within the ASEAN/WTO WG and the GoV for the management of issues arising from accession to international economic regimes
- On an overall basis, demonstrable, improved knowledge and experience of GoV legal officials concerning regional and international economic regimes may be observed, and within WG specific capacity built for treaty making and negotiating techniques
- Competence of MOJ is established in specific policy areas in the field of international economic law, policy and practice
- Capacity is built in proactive legislative strategic planning in the field of economic law both within MoJ and the GOV These results are expected to be achieved through the implementation of the following nine activities.
These results are expected to be achieved through the implementation of various activities, some relate to pre-accession and some relate to post-accession of the WTO
CJE component
LERAP activities aim at contributing to the improvement of justice in Vietnam by enhancing Civil Judgment Enforcement through improving capacity of executing officers and capacity of the MOJ to effectively manage the system of civil judgment enforcement.
The results initially planned to be achieved through the CJE Component included:
- Output 2100 : Increased capacity of DCJE to manage the activities o the Department and regional staff
- Output 2200 : Capacity built in MOJ to train civil judgement enforcement officers on the basis of the new legislative framework and management system
- Output 2300 : Integration new management information system into the management and planning of civil judgment enforcement Under this AWP the focus with be on the second Output
COM component
Project activities under the component focus on contributing to the development and enhancement of specialized capacity to undertake comparative law analysis and legal research for the MOJ's legal specialists (almost all coming from the ILS and HLU), through which enhance quality and practicality of the ILS's contributions to addressing the relevant core task of the MOJ and of HLU's research and teaching practice will be achieved.
Planned results of the component are
- Building capacity to strengthen the expertise of selected elements of the broader legal community in comparative law methodology and analysis
- Specialized capacity to undertake comparative law analysis and legal research in the MoJ (ILS) and HLU is developed, enhancing the quality and practicality of: (i) ILS’s contribution to addressing the relevant core tasks of the MoJ (legislative drafting, legislative review and legislative planning, and, (ii) HLU’s research and teaching practice
